Terms of use
For reasons of easier legibility and comprehension, all Austrian Power Grid AG webpages will sometimes refrain from differentiating between genders and persons. If only one noun is used as a personal description (e.g. employee, colleague or user), this is taken to mean women, men and various persons on an equal basis.
Applicability and scope of services
The subject of these Terms of Use is the use of the webpages (subsequently referred to as “APG webpages”) provided by the Austrian Power Grid AG (subsequently referred to as “APG”).
On its webpages, APG offers industry-related and company-related information for customers, partners and the general public.
Furthermore, individual services (e.g. special customer portals) may be offered which are subject to special terms of use and/or require special registration. These special terms of use replace or supplement the Terms of Use for APG webpages and have priority over them.
Visiting and/or using APG webpages constitutes an acceptance of the Terms of Use for APG webpages in their current version. APG is entitled to change these Terms of Use at any time.
APG is entitled to adjust its webpages in their entirety or in part and/or to change in any way the content or services. APG accepts no responsibility for any interruption in the availability of APG webpages. There is no entitlement to the use or the maintenance of APG webpages.
Provided that a user of APG webpages is not defined as a consumer under Section 1 of the Consumer Protection Law (Konsumentenschutzgesetz, KSchG), then Sections 9 and 10 of the E-Commerce Act (E-Commerce-Gesetz, ECG) shall not apply.
Property rights
Graphics, images and text that are displayed on APG webpages are the property of APG. APG reserves all rights to these and other materials as well as their placement on APG webpages. Brands, images, text, portions of text, the design and other content of APG webpages may not be changed, copied, reproduced, used, supplemented or otherwise exploited for commercial purposes respectively without the prior written permission of APG (for personal, non-commercial and non-public use).
Liability

APG shall only accept liability in cases of criminal intent or gross negligence. APG does not accept liability for loss of profit, missed savings, lost or amended data, indirect damages and damages resulting from third-party claims, unless mandatory rules state otherwise.

APG does not accept liability for outdated, incorrect or missing information on APG webpages. For this reason, all decisions that are based on information on APG webpages remain solely the responsibility of the user. In particular, APG does not accept responsibility for direct, specific damages or consequential damages or other damages of any kind that – for whatever reason – arise in connection with the indirect or direct use of information provided on APG webpages.

APG accepts no responsibility or liability for services offered on APG webpages that are facilitated, provided or otherwise made available by third parties.

APG has made every reasonable effort to ensure that the information supplied on APG webpages is correct and complete at the time it was provided. If any errors or mistakes are made known, these will be corrected as quickly as possible. The content provided may be changed or supplemented at any time without prior announcement. External content which is referenced by means of a hyperlink is not within APG’s sphere of influence or responsibility.
Availability of APG webpages

APG endeavours to ensure the continual operation and accessibility of its webpages – to the extent that this is possible given the prevailing technical, economic, operational and organisational circumstances.

APG does not provide any warranty or guarantee that APG webpages or their content will be available without interruption or at all, or that they will be without error or that any errors will be remedied. APG also does not provide any warranty or guarantee that APG webpages or resources (such as servers) will be free from viruses or other hazardous elements. APG explicitly rules out any liability for damages, of whatever kind, from the provision of APG webpages or resources, insofar as this is permissible in law.

APG accepts no responsibility for periods in which these are not available for technical reasons or due to other problems.
Applicable law and place of jurisdiction
Only substantive Austrian law shall apply, excluding the relevant provisions of international private law and excluding the provisions of the United Nations Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction shall be Vienna, unless mandatory rules state otherwise.
Final provisions
Should individual provisions from these Terms of Use be wholly or partially invalid or be incomplete, the effectiveness of the remaining provisions or parts of such provisions shall remain unaffected. An invalid provision shall be replaced with a legally valid provision whose objective is as close as possible to the original provision.
